Analysis of Legislation Impacts of Conditional Suspension of Indictment on Victims of Domestic Violence According to the Special Act for the Punishment of Domestic Violence

Conditional suspension of indictment was introduced based on Article 9.2 of "Special Act for the Punishment of Domestic Violence" in 2007 and has been enforced up to now. This report analyzed legislation impacts of conditional suspension of indictment and proposed legislation and policy implications. To achieve the policy goals based on the analysis results, the followings were proposed as legislation and policy tasks; (1) To institutionalize Risk Assessment and Selective Test of domestic violence offenders, (2) To clearly define cases which fall in conditional suspension of indictment, (3) To enhance the quality of consultation and increase consultation time and period, (4) To consider dropouts giving criminal punishment, and (5) To supplement institutions to protect domestic violence victims.
